Constitutionalism vs Constitution
Elaboration
- Constitution: The fundamental legal document that distributes power, defines institutions, and guarantees rights. It exists even in authoritarian states.
- Constitutionalism: The doctrine/ideology of limited government: power must be exercised according to rules, with checks, accountability, and protection of rights. It is a normative idea, whereas a constitution is descriptive.
- Key difference: A constitution can exist without constitutionalism (e.g., a document that exists on paper but allows dictatorship), but constitutionalism cannot exist without some basic constitutional order.
- Features of constitutionalism: Rule of law, separation of powers, independent judiciary, fundamental rights, periodic free elections, civilian control of the military, free press, accountability of government.
- Indian context: Constitutionalism is reflected in Kesavananda Bharati (1973) (Parliament cannot destroy the basic structure), Art 13, 32, 226 (judicial review), Art 14, 21 (rights). Ambedkar warned (25 Nov 1949): a constitution is only as good as the people who run it, hence the need for constitutional morality.
- Types: Political constitutionalism (Parliament as the ultimate check) vs legal constitutionalism (courts as the check); India leans toward legal constitutionalism with political accountability.
- Thinkers: Locke, Montesquieu, Madison; in India, Granville Austin, K.C. Wheare.
Key points to remember
- Constitution = the document; Constitutionalism = the spirit of limited government.
- "Constitutional government" (UPSC recurring): a government limited by the terms of the Constitution.
- Kesavananda is the greatest expression of Indian constitutionalism.
- Indian examples of constitutionalism: judicial review, FRs, independent institutions, elections.
